These Terms and Conditions set out the basis on which Rubbish Removal Ealing provides rubbish removal, waste collection and related services. By booking or using our services, you agree to be bound by these Terms and Conditions. If you do not agree with any part of these terms, you should not proceed with a booking.

1. Definitions

In these Terms and Conditions, the following expressions shall have the meanings set out below:

Client means any individual, business, landlord, agent or organisation that requests or uses our services.

Company, we, us or our means Rubbish Removal Ealing, the service provider.

Services means any rubbish removal, waste collection, clearance, loading, transportation, disposal or related work carried out by the Company.

Booking means a confirmed request for Services, whether made by telephone, email, online form or any other agreed method.

Waste means any rubbish, refuse, junk, furniture, appliances, garden waste, builders waste or other items to be removed by us, excluding any Prohibited Waste.

Prohibited Waste means items that we are not permitted or insured to collect or transport, including but not limited to hazardous, toxic, corrosive, explosive or clinical waste, asbestos, chemicals requiring specialist handling, pressurised containers, gas bottles, certain electrical items and any material for which we do not hold the required licences.

2. Scope of Services

We provide rubbish removal and waste collection services for domestic, commercial and office customers. Our services may include loading items from your premises, transporting them and arranging lawful disposal or recycling at an authorised facility.

Unless agreed otherwise in writing, our services do not include dismantling permanent fixtures or fittings, structural work, deep cleaning, pest control or removal of Prohibited Waste. We reserve the right to refuse to handle any items that in our reasonable opinion may pose a health, safety or environmental risk.

All services are provided subject to availability of staff, vehicles and resources and may be affected by traffic, access and other factors beyond our control.

3. Booking Process

3.1 Booking Requests

You may request a booking by telephone, email or via our online enquiry process. To arrange a booking, you will need to provide accurate information about the type and volume of waste, the location of the items, access restrictions, parking arrangements and any relevant time constraints.

3.2 Estimates and Quotations

Any estimate provided prior to arrival is based on the information you give us and is not binding. The final price will be confirmed on site once our team has assessed the actual volume, weight, type of waste and the time required. If the waste differs significantly from the description given at the time of booking, we may revise our quotation or, if you do not accept the revised quotation, decline to carry out the work.

3.3 Confirmation of Booking

A booking is deemed confirmed when you accept our quotation and we provide a time slot or date. We may, at our discretion, require a deposit or pre-authorisation of payment to confirm the booking. We reserve the right to refuse or cancel any booking where we believe the request is unreasonable, unsafe or not compliant with applicable waste regulations.

4. Access, Parking and Customer Obligations

You are responsible for ensuring suitable access to the property or site and for providing any information needed for our team to carry out the work safely and efficiently.

You must ensure that:

The waste is clearly identified and accessible at the agreed time.

Any necessary permissions are obtained for entry to communal areas or restricted spaces.

A responsible adult is present at the property for the duration of the booking, unless we have expressly agreed otherwise in advance.

Parking is available as close as possible to the collection location. Any parking charges, permits or fines arising directly from the delivery of our services may be chargeable to you where they result from information you have provided or failed to provide.

If our team is unable to access the property or waste at the agreed time due to circumstances within your control, we may charge a call-out fee to cover our time and travel costs, or treat the booking as cancelled by you.

5. Payments and Charges

5.1 Pricing

Our charges are generally based on the volume and type of waste collected, as well as labour time, access difficulty and any additional services requested. We will explain our pricing basis at the time of booking and confirm the final price before commencing work on site.

5.2 Payment Methods

Unless agreed otherwise, payment is due in full upon completion of the work and prior to our team leaving the site. We accept commonly used payment methods in the UK, which may include cash, major debit and credit cards and bank transfer by arrangement. We do not accept cheques unless specifically agreed in advance.

5.3 Late Payment

Where we agree to provide services on account or issue an invoice with payment terms, payment must be made by the due date stated on the invoice. We reserve the right to charge reasonable late payment interest and administrative fees for overdue amounts, in line with applicable UK legislation on late payments.

5.4 Additional Charges

If on arrival we find significantly more waste than originally described, or waste that is heavier, more difficult to handle or requires additional labour or equipment, we will inform you of any additional charges before continuing. If you do not accept the revised price, we will only remove waste up to the original agreed amount, or we may cancel the service and charge a reasonable call-out fee.

6. Cancellations, Rescheduling and Missed Appointments

6.1 Client Cancellations

You may cancel or reschedule your booking by giving us reasonable notice prior to the scheduled time. We ask for at least 24 hours notice where possible. If you cancel with less than 24 hours notice, we reserve the right to charge a cancellation fee to cover our costs.

6.2 Company Cancellations

We may occasionally need to cancel or reschedule a booking due to unforeseen circumstances such as vehicle breakdown, staff illness, severe weather or other events beyond our reasonable control. In such cases, we will aim to notify you as soon as possible and arrange a new appointment at the earliest convenient time. We will not be liable for any indirect or consequential losses resulting from a cancellation or delay, but any deposits paid for that booking will be either applied to the rescheduled service or refunded.

6.3 Missed Appointments

If our team attends at the agreed time but is unable to access the premises, the waste, or a responsible person to authorise the work due to circumstances within your control, we may treat the booking as a failed attendance and charge a reasonable call-out fee. Any rebooked service will be subject to a new appointment time and may incur further charges.

7. Waste Regulations and Compliance

We operate in accordance with relevant UK waste management laws and regulations. All waste we collect is handled, transported and disposed of through authorised, licensed facilities where required.

By using our services, you confirm and warrant that:

You have the legal right to arrange removal of the waste from the property or site.

The materials presented as waste do not include Prohibited Waste or any items for which special licences or permits are required that you have not disclosed to us in advance.

You will provide accurate information on the nature and composition of the waste to allow us to handle it lawfully and safely.

If our team reasonably believes that any waste constitutes or may constitute Prohibited Waste, we reserve the right to refuse to remove it. We may also request that you provide additional information or documentation to demonstrate compliance with applicable regulations.

8. Liability and Insurance

8.1 Duty of Care

We will carry out our services with reasonable skill and care. Our staff will take appropriate precautions to avoid damage to your property while performing loading and removal activities.

8.2 Limitation of Liability

To the fullest extent permitted by law, our total liability to you for any loss or damage arising out of or in connection with the provision of our services shall be limited to the total amount paid or payable for the relevant booking. We will not be liable for any indirect, incidental or consequential loss, including loss of profit, loss of business, loss of opportunity or loss of data.

We shall not be liable for any damage or loss arising from inaccurate, incomplete or misleading information provided by you, from a failure to comply with these Terms and Conditions, or from matters beyond our reasonable control.

8.3 Exclusions

We do not accept responsibility for the accidental removal of items that you intended to keep, where such items were not clearly separated or identified from the waste. It is your responsibility to check that any items to be retained are safely removed from the clearance area before our work begins.

We do not accept liability for wear and tear or pre-existing damage to property, fixtures, fittings or contents. We are not responsible for any damage occurring due to poor structural condition, concealed defects, or inadequate access routes where we have relied on your instructions or where reasonable care was taken.

Nothing in these Terms and Conditions shall exclude or limit our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be excluded or limited by law.

9. Customer Conduct and Health and Safety

We expect clients to behave in a respectful manner towards our staff at all times. We reserve the right to withdraw our services and leave the site immediately if any member of our team experiences abusive, threatening or unsafe behaviour.

Our team will comply with relevant health and safety requirements and may refuse to carry out work if they believe it would be unsafe, for example due to hazardous materials, unsafe structures, insufficient lighting, blocked access or extreme weather conditions. If work cannot proceed for health and safety reasons arising from your property or instructions, we may charge a call-out fee.

10. Complaints and Dispute Resolution

If you are dissatisfied with any aspect of our service, you should contact us as soon as possible to allow us the opportunity to resolve the matter. We may request details of the issue and evidence such as photographs or invoices. We will investigate complaints in a fair and timely manner and, where appropriate, may offer to rectify the issue, provide a partial refund or make another reasonable gesture, at our discretion.

In the event of a dispute that cannot be resolved directly, both parties agree to consider in good faith any reasonable proposal for alternative dispute resolution before commencing legal proceedings.

11. Data Protection and Privacy

We collect and process personal information such as names, contact details, addresses and payment information to manage bookings and deliver our services. We will handle your personal data in accordance with applicable UK data protection laws. We will not sell your personal data to third parties and will only share it where necessary for the performance of our services, for legal compliance or with your consent.

12. Amendments to These Terms

We may update or amend these Terms and Conditions from time to time to reflect changes in our services, business practices or legal requirements. The version published at the time of your booking will apply to that booking. Continued use of our services after changes are published will constitute acceptance of the revised terms.

13. Governing Law and Jurisdiction

These Terms and Conditions, and any dispute or claim arising out of or in connection with them or with the provision of our services, shall be governed by and construed in accordance with the laws of England and Wales.

You and we agree that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or relating to these Terms and Conditions or the services we provide, subject to any rights you may have as a consumer to bring a claim in the courts of your place of residence within the United Kingdom.

14. Severability

If any provision of these Terms and Conditions is found by a court or other competent authority to be invalid, unlawful or unenforceable, that provision shall be deemed deleted and the remaining provisions shall continue in full force and effect.

15. Entire Agreement

These Terms and Conditions, together with any written quotation or confirmation of booking, constitute the entire agreement between you and us in relation to the provision of services. You acknowledge that you have not relied on any statement, promise or representation that is not set out in these documents.
